Privacy Policy

This Privacy Policy describes how Cell Digital Technology Inc. ("xark.io," "we," "us," or "our") collects, uses, and discloses information about you when you visit xark.io or submit an inquiry through our forms.

1. Information We Collect

We collect information you provide directly to us:

  • Contact and inquiry data: name, email address, company name, website URL, and message content submitted through our contact or audit-request forms.
  • Newsletter subscriptions: email address submitted through newsletter signup forms.
  • Program Health Check scores: responses to our self-assessment tool, stored without personally identifiable information unless you voluntarily provide contact details alongside them.
  • UTM parameters: marketing attribution data (utm_source, utm_medium, utm_campaign) captured automatically when you arrive via a tracked link.

We do not collect sensitive personal information such as payment card numbers, social security numbers, or government-issued ID.

2. How We Store Your Data

Data submitted through our forms is stored in Supabase (hosted on Amazon Web Services infrastructure in the United States) across two tables: service_leads and newsletter_subscribers. Supabase acts as a data processor under our instructions.

Our site is hosted on Vercel (Vercel Inc., San Francisco, CA). Access logs and edge caching data are retained per Vercel's standard infrastructure policies.

3. Why We Collect It

  • Service inquiries: to respond to your request, schedule consultations, and provide the services you asked about.
  • Newsletter: to send the affiliate marketing content you requested. You can unsubscribe at any time via the link in any email.
  • Analytics: to understand site traffic and improve our content, using aggregated, non-personally-identifiable data.

4. Cookies and Tracking Technologies

We use the following categories of cookies and tracking pixels:

  • Essential cookies: we do not set any first-party essential cookies ourselves. Session management is handled server-side.
  • Analytics cookies: Google Analytics (if connected) may set cookies to measure page views and traffic sources. This data is aggregated.
  • Advertising pixels: Meta Pixel and TikTok Pixel are loaded only after you accept cookies via our consent banner. These pixels help us measure ad performance. They are not loaded if you decline or have not yet interacted with the banner.

5. Third-Party Services

  • Supabase — database and backend (data processor)
  • Vercel — site hosting and CDN
  • Google Analytics — traffic analytics (if connected; see cookie section)
  • Meta (Facebook/Instagram) — advertising measurement (consent-gated)
  • TikTok — advertising measurement (consent-gated)

We do not sell or rent your personal information to any third party.

6. Your Rights

You have the right to:

  • Access the personal information we hold about you.
  • Request correction of inaccurate data.
  • Request deletion of your data.
  • Opt out of marketing emails via the unsubscribe link in any email we send.

7. California Residents (CCPA)

If you are a California resident, you have the right to:

  • Know what categories of personal information we collect and why.
  • Delete personal information we have collected from you.
  • Opt out of the sale of personal information. We do not sell your personal information to third parties.
  • Non-discrimination for exercising these rights.

8. EU/EEA Residents (GDPR)

If you are located in the European Union or European Economic Area, our lawful basis for processing your data is:

  • Legitimate interest — for responding to service inquiries submitted through our contact forms.
  • Consent — for marketing pixels (Meta, TikTok) and any email marketing you opt into.

You have the right to lodge a complaint with your local supervisory authority. To withdraw consent or request data deletion, email privacy@xark.io.

9. Data Retention

We retain inquiry data for up to 3 years from last contact, or until you request deletion. Newsletter subscriber data is retained until you unsubscribe.

10. Changes to This Policy

We may update this policy periodically. Material changes will be noted with a revised "Last updated" date at the top of this page. Continued use of the site constitutes acceptance of the updated policy.
