FTC Disclosure Requirements

The FTC requires clear and conspicuous disclosure whenever there is a 'material connection' between a publisher and a brand — including affiliate commission relationships. Disclosure must appear: before any affiliate link, above the fold on the page, in plain language ('This post contains affiliate links. We may earn a commission if you buy through our links.'). Hashtags like #ad or #sponsored are acceptable on social media. Buried footer disclosures do not meet FTC standards.

Brand responsibility extends to publisher compliance — if your publishers are not disclosing, your brand is at risk. Required brand actions: include disclosure requirements in your publisher agreement, audit publisher content quarterly for compliance, terminate non-compliant publishers after warning, document your compliance audits.

Trademark & Brand Protection

Common publisher compliance violations: unauthorized trademark bidding (bidding on your brand name in Google Ads), coupon creation without authorization, price misrepresentation, fake review creation. Australia: ACCC has disclosure guidelines similar to FTC. If you have publishers in these jurisdictions, ensure your publisher agreement references applicable local requirements.
