FTC Endorsement Guidelines (Affiliate)

The Federal Trade Commission's regulatory framework governing how endorsements, testimonials, and sponsored content — including affiliate marketing and influencer partnerships — must be disclosed to consumers in the United States; formally titled 'Guides Concerning the Use of Endorsements and Testimonials in Advertising' and updated in 2023 to address social media and influencer marketing. The FTC Endorsement Guidelines establish the disclosure obligations that apply to affiliate publishers, influencer marketers, and the brands that work with them. Key principles of the FTC Endorsement Guidelines: Material connection disclosure: any material connection (financial, product-based, or relationship-based) between an endorser and a brand must be disclosed clearly and conspicuously in content where the endorsement appears. Clear and conspicuous standard: disclosure must be placed where consumers are likely to see it, in language they are likely to understand; placement at the end of content, in small print, or in ambiguous language does not meet this standard. Honest opinions: endorsements must reflect the genuine opinions and experience of the endorser; a creator who says they love a product they have not used, or who makes up favorable experiences with a product, violates FTC guidelines; affiliate commission does not require a positive review, but it does require disclosure of the commission relationship. Platform responsibility: the 2023 update explicitly stated that platforms (social media companies) share responsibility for ensuring their platforms do not facilitate non-compliant endorsements; this has prompted TikTok, Instagram, and YouTube to implement their own disclosure tools. Enforcement: the FTC has brought actions against brands, influencers, and publishers for non-disclosure; enforcement has focused on patterns of non-disclosure rather than isolated incidents; both civil penalties for brands and public corrective actions for influencers are available enforcement tools.
